Terms of Service

1. Agreement to Terms

By accessing or using the SellrApp platform (the "Service"), operated by Thekada Digital Ventures Pvt Ltd ("Company", "we", "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

2. Description of Service

SellrApp is a software-as-a-service (SaaS) platform that enables businesses to create online storefronts and receive orders via WhatsApp. The Service includes store creation, product management, storefront hosting, and order routing through WhatsApp messaging. SellrApp is a store-building and order-routing tool — we do not process payments between you and your customers, nor do we handle logistics or delivery.

3. Account Registration

  • You must be at least 18 years old to create an account.
  • You must provide accurate and complete information during registration.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You are responsible for all activities that occur under your account.
  • One WhatsApp number may be linked to only one store at a time.

4. Subscription & Payments

Free Trial: New users receive a 7-day free trial with access to all features. No credit card is required to start the trial.

Subscription Plans: After the trial, continued use of the Service requires an active paid subscription. Plans are available on a monthly or annual basis, with pricing displayed on our Pricing page.

Payment Processing: Subscription payments are processed through in-app purchase on iOS and Android platforms. By subscribing, you also agree to the respective platform terms of service.

Price Changes: We reserve the right to change pricing at any time. Existing subscribers will be notified at least 30 days before any price increase takes effect on their account.

5. Acceptable Use

You agree not to use the Service to:

  • Sell illegal, counterfeit, or prohibited goods or services
  • Engage in fraudulent, deceptive, or misleading business practices
  • Violate any applicable local, state, national, or international law
  • Infringe on the intellectual property rights of others
  • Distribute spam, malware, or harmful content through your store
  • Attempt to gain unauthorized access to the Service or its infrastructure
  • Resell or redistribute the Service without our written consent

We reserve the right to suspend or terminate accounts that violate these terms without prior notice.

6. Store Content

You retain full ownership of all content (product images, descriptions, store branding) that you upload to the Service.

By uploading content, you grant us a non-exclusive, worldwide license to host, display, and distribute your content solely for the purpose of operating the Service (i.e., displaying your store to visitors).

You are solely responsible for ensuring that your store content does not violate any third-party rights, including copyrights and trademarks.

7. WhatsApp Integration

SellrApp uses WhatsApp's click-to-chat URL feature to route orders. We are not affiliated with, endorsed by, or in partnership with WhatsApp Inc. or Meta Platforms Inc. Your use of WhatsApp is governed by WhatsApp's own terms of service. We do not access, store, or monitor your WhatsApp messages or contacts.

8. Service Availability

We strive to maintain the Service at high availability, but we do not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any loss or damage resulting from service downtime.

9. Limitation of Liability

To the maximum extent permitted by law, Thekada Digital Ventures Pvt Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or business opportunities, arising from your use of the Service. Our total liability for any claim arising from the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.

10. Termination

By You: You may cancel your subscription and delete your account at any time from your dashboard. Your store will remain active until the end of your current billing period.

By Us: We may suspend or terminate your account if you violate these Terms, engage in prohibited activities, or fail to pay subscription fees. We will make reasonable efforts to notify you before termination, except in cases of serious violations.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Kerala, India.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated date. Continued use of the Service after changes constitutes acceptance of the revised Terms. For material changes, we will notify you via email or through the Service.
